Trade and China Piracy

Beware of what you purchase online, especially when it comes to drugs as most of the websites are actually shadow companies located in China. China is the biggest piracy participant of American protected materials and patented drugs. The website appearing in the link although having the name “,US drugstore”, is not an American company. It’s a Chinese company hiding behind the name. Trying to deceive us.
The U.S. Commerce Department estimates suggest that U.S. companies lose over $1 billion per year of legitimate business due to piracy, while the U.S. Trade Representative calculates that more purchases of legitimate software and entertainment media alone would reduce the U.S. trade deficit with China by $2.5 to $3 billion per year. Understanding which businesses are most vulnerable to these losses is important for investors evaluating a company’s China strategy.

David Smith-Hallandale Beach Blog= Liar

David Smith of the Hallandale Beach Blog is a Liar. Being in public office for 30 years, almost everyone will tell you they become somewhat immune to the personal attacks, criticisms and negative public comments about them.  In other words, you need to be thick skinned if you intend to remain in public office.

David Smith writes a blog, for the most part about the City of Hallandale Beach Florida. This post, is a simple and limited response to some comments he made about me and other parties.  I’m not going to provide a link to his blog and thought long hard before responding, as I do not desire to provide him any more recognition.

Smith hides behind his computer in a trailer where he lives with his father. His sole purpose in life is to better the elected officials and employees, for the city of Hallandale Beach Florida, save for Commissioner Keith London.  Figuratively speaking, it’s obvious that he and Keith London are in bed.

The tacit motives of Hallandale Beach, Commissioners, London and Lewy

The tacit motives of Hallandale Beach, Commissioners, Keith London and Alexander Lewy to erode the Council-Manager form of government in the city of Hallandale Beach Florida. They are also strong arming the Charter Review Committee in an effort to have them propose policies regressive to the council-manager form of government.

Hallandale Beach, Florida, Commissioners Keith London and Alexander Lewy are attempting to hijack the charter review committee. London is a power hungry elected official intent on dwindling down the Council-Manager form of government.
Currently, he is seeking through his charter review representative to alter the existing appointment structure of the City Clerk. Currently, the city clerk is appointed by and reports to the City Manager. Keith London believes the City Commission has more expertise at selection, recruitment and managing the position and therefore the elected officials should appoint and supervise the city clerk. He makes this comment without a single day of management, administrative and recruitment experience. This is not unusual for elected officials whose ego has blown out of control to believe they are an expert on every subject. Facts are, London has no idea how to manage an organization.
His past actions are emblematic of his strategic regressive behavioral strategy to erode the council-manager form of government.

The Truth

On July 18, 2011, newly elected Commissioner, Alexander Lewy, made a motion requesting staff be given authority to directly approach commissioners on issues when they believe their opinions were not adequately addressed by their director or the city manager.  The motion and action was taken without any supporting documentation and backup material provided by Commissioner Lewy. And of course Commissioner Keith London, made a motion to cut off debate, to support the motion. The motion passed with the help of Vice Mayor Sanders. Commissioner Dotty Ross and Mayor Joy Cooper voted against the measure to cut off debate in an effort to preserve the Council-Manager form of government. This is part of a continuing tacit effort by Commissioners London and Lewy to erode the form of government.

Even though the motion passed, there are two interesting issues pertaining to this item.

1- First, there was no item listed on the special meeting agenda in regards to altering the “Protocol Manual” which among other issues, illustrates the relationship between the legislative body and the staff. Robert’s Rules of Order generally dictate that action should not be taken without the matter appearing on a formal agenda. Appearance on the agenda prior to the special meeting would have provided commission members the ability to research the matter in order participate in an informed debate. Why Mayor Cooper would permit such an item to be addressed without forethought and during a special meeting dealing with the budget, is perplexing. There appears to be little rhyme or reason to the structure of meetings and a lack of orderly process.

2- The second issue, begs the question; was the action in violation of section 3.07 of the city code of ordinances? Paragraph three of section 3.07 of the code clearly addresses whom the Commission and how they communicate with the officers and employees of the city that are under the direction of the city manager. The section is quoted below.

(3)     Interference with administration. “Except for the purpose of inquiries and      investigations, the commission or its members shall deal with city officers and employees who are subject to the direction and supervision of the manager solely through the manager, and neither the commission nor its members shall give orders to any such officer or employee, either  publicly or privately. Nothing in the foregoing is to be construed to prohibit individual members of the commission from closely scrutinizing by questions and personal observations all aspects of the city government operations so as to obtain independent information to assist the members in the formulation of policies to be considered by the commission  and assure the implementation of such policies as have been adopted. It is the express intent of this provision, however, that such inquiry show not interfered directly with the ordinary municipal operations of the city and that recommendations for change or improvement in city government operations be made to and through the city manager.”

The provision of section 3.07 of the city code is commonplace within most council – manager forms of government, and this exact provision or a paraphrase thereof specially exists in most council – manager forms within the State of Florida.  When checking with a long term city Atty. within Broward County Florida, the individual desires to remain anonymous, stated the action by Commissioner Lewy, violates the code provision.

Prior to analyzing the motion made by commissioner Lewy, to the erode the council-manager form of government within Hallandale Beach, a brief history of the council-manager form and the logic for establishing a protocol manual.

In 1974, I was employed by the city of little rock Arkansas as a management analyst.  One of my first assignments was that of a the city protocol manual on commission-staff relations.  In brief manual provided guidelines and interpretations on the various issues regarding the legislative body and staff relationships.  The manual reduced conflicts and provided valuable information to newly elected officials.  Whenever a dilemma existed between the elected officials and the staff, the resolution was always added to the manual in order to prevent a future recurrence.
Under the council-manager form, typically all employees, save for the city attorney and his staff, theoretically work for the city manager.  In order to have proper information to make informed decisions, commissioners are generally permitted to ask staff questions but may not consume more than 15 minutes of an employee’s time.

 

The intent of section 3.07 has been interpreted on numerous occasions throughout the United States.  Let’s take a closer look at the provision and elaborate specifically as to why commissioner Lewy’s motion violates the provision. First, the provision notes, “the commission or its members shall deal with city officers and employees who are subject to the direction and supervision of the manager solely through the manager.” The section of the provision cited in the previous sentence, clearly prohibits the commission from dealing with employees, except through the city manager.  Therefore, Commissioner Lewy’s motion violates the city charter.

This article provides facts and figure’s that indicate the number of employees employed by the Federal government and the Clinton and Obama administration’s were less than those of modern a republican administrations.  To claim that Obama is a big government liberal doesn’t coincide with the facts.  The statistics and records show that Ronald Reagan employed more than 30,000 Federal personnel than Obama.

Rick Perry’s after switching from the Democratic to the Republican Party was required by top party officials to have a mental evaluation for candidacy. Perry visited a mental asylum and asked the director, “How do you know when a person needs to be institutionalized?”
“Well, we fill a bathtub with water and offer them a teaspoon, a teacup and a bucket and ask them to empty the tub.” Perry said, “I see; a normal person chooses the bucket cause it’s bigger.” The director responded, “NO. A normal person would pull the plug- We will advise the property authorities that you are fit for office as a Republican.  You should do well.

Rick Perry-The Real Rick-Part 2-Job Creation-Employment-

Just what are the facts regarding the history of Rick Perry’s ability to create record and maintain a stable employment rate.  Are his campaign speeches, chest beating and rhetoric pertaining to job creation and his employment record factual?  The short answer is, no. There is a tinge of truth to some of what he says but in the end, without the stimulus most of the researchers presenting information on this subject will tell will tell you his unemployment rate would be higher and job creation numbers lower.

Rick Perry was born on March 4, 1950 in Paint Creek Texas in the western part of the state, and 60 miles north of Abilene. His father, Joseph Ray Perry , served as a long term  Haskell County commissioner and school board member. Perry attended Texas A&M University, where he was a member of the Corps of Cadets, and a member of the Alpha Gamma Rho fraternity. He graduated in 1972 with a 2.22 GPA, earning a bachelor’s degree in animal science.
Upon graduation, he was commissioned in the Air Force, completed pilot training, and flew C-130tactical airlift in the United States, the Middle East, and Europe until 1977. He left the Air Force with the rank of captain, returned to Texas, and went into business farming cotton with his father.
Perry has said that his interest in politics probably began in November 1961, when his father took him to the funeral of U.S. Representative Sam Rayburn (D-TX), who during his long public career served as speaker of the Texas House for a short time at the age of 29 and then later for 17 years as the Speaker of the U.S. House of Representatives.
In 1984, Perry was elected to the Texas House of Representatives as a Democrat from district 64 that included his home county of Haskell. In 1987, Perry voted for a $5.7 billion tax increase proposed by Republican governor Bill Clements. Perry supported Al Gore in the 1988 Democratic presidential primaries and chaired the Gore campaign in Texas.
In 1990, as a new Republican, he challenged incumbent Democratic Agriculture Commissioner Jim Hightower. Hightower had worked on behalf of Jesse Jackson for the Democratic presidential nomination in 1988.
In 1998, Perry, ran for the office of Lieutenant Governor to succeed the retiring Democrat Bob Bullock and obtained 50.04 percent. He became the state’s first Republican lieutenant governor since Reconstruction, taking office on January 19, 1999.  He assumed the governorship on December 21, 2000 following the resignation of then-Governor George W. Bush who won the election for President.

October 15, 2010-
Rick Perry Struggles to answer a question on abstinence in the public schools.  A requirement that he instituted that does not seem to be effective.  In fact, Texas ranks third in the country and teenage pregnancies.  An excellent video showing how Perry cannot intelligently answer a question.  Do we really want a person to serve as President that can’t respond directly to a question regarding a policy he instituted?

March 4, 2010-Bill White, Rick perry’s opponent for the gubernatorial election in Texas in 2010 indicated that the Texas debt doubled under the governorship of Perry.  PolitiFact.com investigated the statement and determined that White’s was correct.  As hypocritical as this statement appears, it has become commonplace among republican candidates over the past several years.  The truth obviously this seems to escape them.  What’s even more discouraging, is that republican voters are like sheep led to the slaughterhouse.  That’s what you get when you have to sign a loyalty oath. Education:
July 2, 2010-Congress creates law to prevent Rick Perry’s inappropriate utilization of Federal stimulus monies for education.  In violation of the rules, Perry reduced state funding and supplemented the difference with Federal stimulus monies.  This is an unethical practice which had to be stopped by Congress.
August 1, 2011- Rick Perry cut four billion dollars from the state education budget and as a result, 12,000 teachers have lost their jobs.  Many more are expected to lose their jobs when administrators sort out the funding shortfall.

Execution of a likely innocent man:
Cameron Todd Willingham, executed in 2004 for an arson that many fire experts believe he did not start.The fire leveled his house and killed his three daughters.  He was subsequently found guilty and sentenced to death, after refusing a plea agreement that would place him in prison for life. In 2004, Governor Rick Perry, denied a last-minute request for a stay of execution.  New facts had emerged indicating through scientific analysis that there was no evidence of arson.
Perry, later removed several members of a state panel investigating the case — a move designed to delay a politically damaging report from the panel, critics charge. The vast majority of evidence and reports over the last several years indicated that governor RickPerry acted inappropriately by not considering the more contemporary findings.  If true in the facts indicate same, he and the people that vote for him should be ashamed of themselves.
December 9, 2004-Several months after Cameron Todd Willingham, was executed, the Chicago Tribune consulted with four arson experts to investigate the evidence.  This link and the report is one of the first investigations indicating fault the evidence was presented that resulted in a guilty conviction of William.  The Chicago Tribune notes, “According to four fire experts consulted by the Tribune, the original investigation was flawed and it is even possible the fire was accidental.” Rick Perry, prior to the execution, rebuffed a report from an eminent fire scientist questioning the evidence.
